child support enforcement help
in April of 2005,I took my ex back to court for contempt and to follow through with a child support adjustment hearing that I had started in Florida.
My ex was found in contempt for non-payment of child support and unpaid medical for 10 years.
NC Child support said he was not in contempt because the case had moved from Florida to NC. During the 4 month transition he refused to pay, but that didn't count against him according to NC Child Support Enforcement. He sat through court cases telling everyone that he was still paying Florida and had no idea where the money was going.
NC Child support enforcement sent his employer a notice for wage with holding in Dec of 2004.
He was already over $40,000 in arrears.
I still had a pending case for an increase from Florida which is why he moved the case. Child support in Florida sent me an increase letter but could not find him to serve him and in the meantime he moved the case, so he was never made to follow through with the increase.
I got a private attorney and he was found in contempt and I was given an increase but at a much lower level. The judge, however gave him an increase in the amount he was to pay to arrears.
Since the April hearing he has not complied with the order. Our attorney sent his employer a copy of the new order. When NC child support found out, they said that only they could do that, but they technically were not party to the action yet. NC child support then sent his employer a wage withholding form as well. I believe they sent the wrong amount. He continued to send the wrong amount.
My case worker asked me what my problem was since he wasn't far behind.
I would like to collect the amount the judge ordered. My ex is a chemical engineer--he has the brains to know what is owed and what needs to be done.
I would like to have the collection done correctly. I don't care who is at fault whether it is child support or him. Child support won't take him to court until he is far behind because he owes a lot of arrearage each month on top of child support.
There really is a problem with a system like this.
