What is the name of your state (only U.S. law)? TexasI terminated the father's rights and the judge ordered him to pay back child support and medical arrearages that at the time was around 4500.00. He never paid a dime and with interest owes more than$19,000.00. He is taking me to court on friday this week to say he does think he should pay it. what do I need to say?:confused:

And what "reasons" :rolleyes: is he giving that he should not pay?

All you really need to say is that you do not agree with waiving the arrearages. The burden of proof is on him. Its not likely that the judge is going to waive the arrearages unless he has some really compelling reasons (like he is totally medically disabled, has no assets, and will never have the ability to pay).

A judge however, might waive some of the interest. 4500.00 to 19000.00 is a huge jump.

You also might offer to settle with him. You might agree to accept an amount smaller than 19k, if he ponies it up in a lump sum now.

Another issue that might come up is- what steps have you previously taken to enforce the order? And, how long ago was the TPR and order issued?
