child support enforcements not doing their job

What is the name of your state? Kansas

My daughter divorce was finalized July 17, 1997. she and her husband was married 9-10-1995 and when he found out she was pregnant, he left her. They had only been maried for 2 months. since the birth of my grandson (6-7-1996), the father has only seen him a few times.

The divorce papers stated that he was to pay $121 a month in child support and he never did. Finally it was decided that the support would be taken out of his paycheck. When Kansas child support enforcements started doing this he quit his job and filed for parental severance of rights. After a time, he was in arrears and child support enforcements allowed him to file bankruptcy on the past due amount that totaled over $2000.

Recently, March 7th, 2005, child support enforcements took him back to court to raise the child support award and the award was granted but they are still drawing out the old amount. $24.80 a week. Hardly ever does my daughter get that amount. Last week she only received $9.48 and that is the norm.

Whenever my daughter complains to child support enforcements they send her to Kansa Payment Center which disburses the child support checks. They in turn send her back to Child support enforcements.

My question is: Is there anyone one or anyplace that she can turn this into to find out what is really going on? According to the paperwork done on March 7th, she is supposed to be getting $45 a month.

The father does not want to see his son, even tho we have made every attempt for him to be involved in his son's life all he does is state that he is going to sever his rights. My daughter has not remarried but he did 5 years ago. His new wife had 2 children that she gave up 3 years ago and she is behind this latest push to sever his rights.

But there has to be something we can do to get the correct amount of child support, isn't there?

Realistically, if someone is determined not to pay child support collecting from them can be difficult to impossible. Yes, the arrearages will continue to build up and eventually you may get something out of him....but the odds are that your daughter is still going to be trying to collect the arrearages long after the children are adults.

She should certainly continue to pursue things....but she needs to have realistic expectations. It looks like she is going to have to raise this child on her own...and count any child support she is able to collect as a "bonus".

If so, how can the state discharge it without her written consent?

She has to allow him to sever parental rights, and if she is smart, she won't do it. [/B] Unfortunately, she also has no way of forcing him to have a relationship with his child.
