Iam a stepmother and my stepdaughter lives in upstate New York. Her mother said she wants more support money and our bills are so high that we do not have more to give. My husband and I would like to know if when the seventeen percent is taken for support is it from both of our incomes or just his. I currently make more money than he does as I am a teacher and make 30,000 and he is a student working as a Teachers Assistant and makes 15,000 a year. We have read your other threads and know that the state looks at line 22 of your income tax form when trying to decide the payment amount. We want to know if they subtract my income from line 22 or if they take from both of our incomes since that is what is on line 22 and since we are married. Also do they take our bills into consideration at all and do they consider that the mother has only worked approximately a year in 9 years of her daughters life or do they take sympathy on that. How can we find out more about the law and if they take from my money even though I am just they step-parent. Please help, it will be greatly appreciated.
