Child support in which state???

My boyfriend who lives with me in Wisconsin has a daughter in his home state Indiana.He pays no support but when he sees her he gives her everything she needs and wants.His ex will not allow him to take his daughter to Wisconsin until he starts giving her money.I dont know her to well but he says that the money wont go for his daughter at all.He wants to start sending her $50 a week,I told him that if she would ever take him to court,whatever money he gave her would be considered a "gift",and would not be consisdered child support.His daughter is 4 and we are both afraid that if we give her money,she can always go back and say we never did.He wants to pay support but we are not sure if we haveto get it started here in Wisconsin or in Indiana.His ex does not want to go to court,but I dont want him to get screwed in the long run.Does anyone know anything about this???I was going to talk to the child support dept.here but thought that I would ty my luck here!!!!!

My response:

You don't need any "luck". It's all cut and dried law.

Jurisdiction always follows the child, as long as residency requirements are met. Therefore, since the child lives in Indiana, the Indiana courts have jurisdiction over the child. That's where all child support, visitation and custody proceedings must take place.

I just saved you $500.00 in attorney fees.

My lawyer has told me that in the state of GA, jurisdiction is held by the county in which the divorce was filed. So you might want to check. My ex lives in a state where the case follows the child so sometimes they contadict each other.

My response:

Early, you're too early. You've misunderstood the post of our original writer. The parents have never been married, and have never been to court for support.

So, in THIS instance, jurisdiction is where the child resides. If the mother wants regular child support payments, the mother will need to file in the State where the child lives.
