I had a hearing yesterday to determine a child support amount for my son's mother to pay. Long story short, the date was rescheduled for a month from now.
Two questions:
1) I filed for child support about a month ago. When an amount is set, will it be backdated to the date that I filed, or not until the order is actually signed? The reason the hearing was rescheduled is because my son's mother claims she was never served (through the mail, as I was supposed to do). Nevermind that she obviously knew about the hearing as she showed up.
2) She stated in court that she doesn't care how much child support she has to pay because since she is receiving public assistance whatever amount she is ordered to pay in CS, her assistance will just go up by that amount. Is this even remotely correct? I don't even know how she can be receiving assistance sine she has no dependents and makes quite enough to live on herself.
I'm actually wondering if she isn't fraudulently claiming my son as a dependent in order to qualify for benefits. Two years ago she was told by the judge that she was not to apply for benefits and use my son as a dependent since she hardly ever sees him and doesn't support him at all.
It makes me feel guilty for asking for CS if it's just going to throw the burden right back on the taxpayer.
