What is the name of your state (only U.S. law)? PA
My 2001 support order is up for review so I filed for an increase due
to the decrease in visitation of the NCP (I have primary physical and
legal no ordered visitation schedule) and for my sons medical
expenses. Our conference is on June 11.
When filing for for the increase the intake worker said that a
reduction of visitation is not grounds to request an increase. Is this
true? NCP went from have 2 weekends per month and 9 consecutive weeks
for the summer to no ordered visitation.
I have a lot if difficulty getting reimbursed by NCP for our son's out of pocket
medical expenses. It took two years last time I attempted and cost me
more then it was worth among the lawyers fees and travel expenses. (I
live 180 miles away from NCP in MD). After the $500 that I am
responsible for, NCP tally to reimburse me a tad over $3800 for the past
two years. Can i ask for a set monthly amount to go toward our sons
medical? Our son goes to therapy weekly, sees a psychiatrist at least
once a month and has a number of daily maintenance medications for
asthma, allergies, ADHD, anxiety, and depression. What would I need to take to court to be fully prepared? I already plan to get documentation from
all of his doctors of his future treatment plans and medication
management and a spreadsheet of all the claims for the last 2 years. Would anything else be helpful?
He has a history of not showing for court dates. What will happen if
he doesn't show? Can they put in for an increase and then force him to
appeal? Or would they reschedule?
And then to throw another wrench into the mix, I get a letter in the
mail Saturday from NCP health insurance company dated 5/14/2010 that
my sons coverage ended on 4/30/2010 and was the plan was terminated by NCP's employer. I emailed him asking him about it and he replied less then two hours later that his company change carriers. I then replied asking for him to forward the new information because our son has already had 5 mental health appointments since 4/30 and I haven't heard anything back from him.
He never said that he had new insurance for him, just that his employer changed carriers. Is there any way I can find out on my own whether my son has other coverage? My husband does carry my son on his insurance, but they probably will be extremely reluctant to become primary unless I can prove on way or another my son's heath coverage status. Any suggestions of what I should / can do? I really don't want to alter my son's treatment plan, but I am in no position to be able to afford all the care he needs. We are already in the whole because we don't receive reimbursement from the NCP. Should I file contempt now? Or should I wait until the conference to see if he provides alternate insurance information?
