Hello everyone! I am asking this question for another friend of mine. :) This is in AZ. My friend has custody of her two children....her and ex husband have been divorced now for 8 years. At the time of the divorce, her husband was working as a waiter, so he wasn't making that good of money. He has been paying $140 a month for these two children, since they were divorced. He has had a decent job for many years now, but the c.s. amount has not been raised. The children are now 15 and 13. Does anyone know what her chances of getting an increase would be? Also, how would she go about filing because she cannot afford an attorney? Any input would be greatly appreciated! Thanks!

Child Support can be modified (increased or decreased)without the aid of a lawyer. She can simply petition the court for an increase stating the children's ages,cost of living etc. She can go to the courthouse and file, they will give her and her ex a court date and the judge will determine by her and her exes tax forms and current paystubs, a more current amount.

I recently went to court for child support modification (increase), and it was a simple procedure. My previous amount of support was $68/monthly. I called my case worker, who was assigned my case through my local child support enforcement agency, and she handled everything for me. She sat my court date, and went to court with me. My main reason for needing more support was that my son's daycare was more a week than I recieved a month, and I am a full-time student. I had to provide documentation of daycare expenses of course, because that was my main reason for the increase. Your friend has a good chance of getting a increase...my support was increased to $254/monthly, and my son's father has another child living in his home. Tell her not to worry, she doesn't need a lawyer, but to just call whoever handles her case and explain the details. Good luck to her :-)
