Child Support Issue

I understand that child support is basically paid by the parent who makes the most money to ensure that the children live in the manner they are acustomed to that they did before the parents split.

If that's the case. Is there something the paying non-custodial parent can do: if the custodial parent refuses to work, goes on welfare, collects food stamps, cuts off the cable, telephone, doesn't turn on the air conditioner in the summer or the heat in the winter all because they can't afford it. The custodial parent can work, but would rather live off the freebies that DCSS offers them. Even a part-time job would put the children back in the environment they were accustomed to.

Is there something the non-custodial parent can do??? Can the NC parent take the CP to court to force a Seek Work Order and make her work. The
kids are definitely not living up the standard they were before the divorce, although there is no reason for this at all, other then then CPs laziness.

Please advise

The court can impute an income to the CP. If the conditions borcder on neglect, the NCP can contact CPS and/or file for a change in custody. The NCP can also contact the state to ensure that they know the CP is receiving CS.

That's exactly what my husband did...

Basically the same situation, so my husband went in and filed for custody so that his daughter would have a more stable envirnonment. It's looking good so far,but there's one more step to go before the custody recommendation is written. My advice would be to support your husband in his endeavor, if that's what he's thinking about doing, and research all you can. It's amazing what a nonmotivated parent will find his/herself doing when suddenly forced to re-analyze parenting issues - And it will only improve the child's situation.
 
I can tell you that my fiances judge said no dice, and you can't take her welfare into account. The judge did impute the mom to minimum wage at 40 hour weeks but the mom hasn't worked in 3 years still trying to get her two year degree has every state support possible and she has 2 dental assistant licenses and 4 years book-keeping experience. So good luck, but if the house is really in that condition I would do what the other posters' suggested.

California. Thanks for you responses....Sorry to say, I'm glad we are not alone in this...

We have the children 2 weeks a month, I own my home with a pool before meeting him and we both work full time. We spend alot of time and $$ with the kids, fishing, skiing, etc. Both kids have braces, play weekend sports on teams, etc. We also keep our finances separate, advice from his attorney. Anyhow, like I said earlier, there's no reason these kids need to go from a great environment to a poverty situation 2 weeks a month.

Oh, and she's taking him back to court for a increase in child support, why???someone has to pay for her facials, manicures, and her recent eye lift surgery, and she's telling her daughter she wants to go to Mexico and get a breast augmentation.

Is there an organization that we can write to complain about the current Child support and custody laws??? Is there a website for dads with deadbeat x-wifes??
