child support/medical bills

My ex is taking me back to court for me to pay half of my daughter's braces. We didn't have any ortho insurance and I told him when we were discussing braces that I do think she probably needs them and we would go in half. When he decided that he was financially able, I told him that I couldn't afford to do it at that time and he went ahead and had braces put on her without my consent. Now he wants his half from me.....?? I wasn't involved in any part of her braces, will I be forced to pay him in court? There are a lot of kids out there whose parents can't afford braces. Please help!!!


I would also like some info in regards to parental alienation if anyone has any. Would be much appreciated. Is this hard to prove?

Also, anyone know a lawyer who would take payments to help me out? I don't have a lot of money due to youngest daughter being born with a congenital heart condition.

I could make payments, but now it's the principle of it all. He decided and he did it whether I could or couln't at that time. This isn't the first time he has done this!!

I suppose cutting your nose off to spite him is in the best interest of the child. You already stated that you knew she needed the braces yet could not afford them, what is the difference if he was responsible enough to go ahead and get it taken care of before her teeth became worse?

What does your court order say about medical and dental, and how uninsured costs are to be split up? If they are addressed in the order, you have to pay.

Our court order says that any nonemergency medical is to be discussed and agreed by both parties before doing anything. I am not sure if that would include braces or dental.

Well, you can argue that in court, but in the end you'll end up paying. He will say he did discuss this with you, but it won't matter, because the judge will award him those costs in the end.

Your best bet is to start making payments to him. Keep track, make sure you do it in check form, send them registered mail, return receipt, that way if he rejects the letters and takes you to court, he'll look like an idiot.
