What is the name of your state? AZ
I was finally divorced in Jan 2006. The support is 341.00 monthly. Ex-husband constantly behind. He blames his boss. When can I go to court to have support modified? Also, ex-husband is not paying any of the medical, which is also in the support agreement. How can I fix this? Thirdly, it states in our agreement that he can claim our son every 3 out of 4 years, but I was told since he's behind I can claim our son. Is that true?

What do you mean by "constantly behind" are the payments simply late or does he miss payments all together?

Typically, a support order can only be reviewed every 2-3 years or if there is a significant change in income.

As far as the taxes are concerned, that depends on the EXACT wording of your court order and your state laws. If neither specifically states that he must be current on support in order to claim the children, he gets to claim them. How far behind is he?

You can not modify because he is "behind."

How is he not paying? Are you sending him the bills? What exactly does your order say in regards to this?

If that specific provision is NOT in the court order, then it does not apply.
