Child Support/NCP on welfare

What is the name of your state (only U.S. law)? CA

Recently, my ex filed paperwork to have child support modified. He filed a fake proof of service with the courts. I was never served with the motion, so I was not present at the hearing.

Timeshare is 37% with Dad, and 63% with me(mom). Dad doesn't work, nor does his new wife. The courts ordered an increase of support to $397. They based this amount on the fact that I am the working parent, and dad has a signifigant timeshare. I also pay all the medical, and childcare for our child.

I'm in the process of filing to have this corrected because I was never notified of the hearing, and because I am the custodial parent.

But, recently I found out that dad is on welfare. I've been told that the state can come after me to be reimbursed since I am paying child support. Anyone know if this is true?? Can a NCP file for welfare if they are recieving child support for their child?

just to clarify, you as the CP is ordered to pay the NCP $397?

That is correct.
like CC stated, it doesn't seem the state can come after YOU for supporting him. you are supporting the children on YOUR time and HIS time. legally. you are not legally obligated to support him and his wife.

however, i did go down and file for medical/foodstamps myself so the office had a copy of the order stating i had custody of the children. this way, they had to stop the aid they were sending the FATHER and PATERNAL GRANDMOTHER. i didn't qualify, i just needed to inform them otherwise.
