Okay, here goes, I'm from Georgia (divorced) now living in VA. Ex-wife has custody of daughters (3) and lives in NC. I have been paying child support as ordered and agreed. Ex-wife filed for a increase of child support... No problem, here's the kicker. She was arrested for identity theft against me recently and all I simply want to do is ask for some provisions in the new order when i go to court i.e., (1) none of my personal information be divulged to her, (2) request for claim of exemption of my daughters provided I meet the requirements of providing more than half their support (irs law covers it). Are those reasonable requests? I seem to think so based on my ex-wife's behavior. Let me know your thoughts, my lawyer seems to think otherwise they aren't.

Your personal tax papers and pay check stub should not be revealed to her. It is none of her business what you make. Maybe you should she what she wants and you two meet half way.

Hound Dog, thanks for the response. This woman has had it in for me since we divorced. There is no compromising with her, like I said she was arrested 3 weeks for identity theft against me. I've been dealing with that issue for the last 2 1/2 years. It almost cost me my financial standing, my job and my sanity. She was arrested on 3 felony warrants and has 3 more from another police jurisdiction awaiting her (she doesn't know about those).

All I want to do is go to this hearing knowing that my concerns will be listened to. Do you think they are unreasonable or will a judge grant me my requests?

If a judge grants you the right to claim one or more of your children for income tax purposes, you aren't required to prove that you pay more than half of their support. You might stand more of a chance, however, if you ask to claim them every other year.

Just a thought. Since your ex is looking at a possible prison sentence, you could ask for a change of custody. Her being in jail would certainly signify a significant change of circumstances.

Have to disagree with you.. in a CS modification hearing, each party can request and get all financial information on the other. Tax papers and pay stubs are usually the main documentary evidence.

However, if the parties come to an agreement outside of a hearing, then no information needs to be given out. ie, she asks for $50 more, and he agrees, then no information is exchanged.
