Child Support Problem??

What is the name of your state? Ohio

I have a 9 year old daughter. Last year I had to go to court to get visitation set up due to her mother preventing me from seeing her. I have been seeing her at least 14 days out of the month forever. The court awarded me the same, I get her every other week. So we both have equal time. I provide medical insurance as well.

When I took her to court she decided to ask for more support. At that time I was at an income level of about 35000. My support was set at 94 dollars a week.

I think this is pretty high support. It does not take 400 dollars to raise her for the two weeks out of the month she is away from me. I have since then had 2 children with my wife, and am worried that in a few years she will go back for more money. I am making more now, prolly around 45000 so she could get more right?

At what point does the court say enough? What can I do to avoid paying anything more then what I am now? I could understand if I only saw her occasionally, but I keep her half the time.

I need some advice or wisdom to keep this from becoming a problem. Thank you in advance

You might want to look up wage garnishment info at the labor board. In addition your states Attorney General guidelines on child support. It does seem odd, both having equal time for her to only receive support, it seems you both should be obligated? Is she employed and have you asked your attorney?

Go to this site and check out support establishment. The only thing I can think of is:

You make a lot more money than she does

or

They made a mistake and thought you had her every other weekend instead of every other week.

Try the CS calculator at http://www.supportguidelines.com

In 50/50 custody, one parent can be ordered to pay CS. This is usually based on one parent having a higher percentage of income. The idea being that child(ren) have the same standard of living at both homes. Request a copy of the CS worksheet that was used, from your lawyer.

And yes, a significant rise in salary can justify CS modification. Again, the idea being that the if the parent's standard of living rises, so should the child(ren)'s.

But, I have a question for you. If the father makes $45,000.00 per year, but lives in a single-wide trailer, does that mean the child must also live in a single-wide trailer? And, must it say Winebago?

:p Hmmmmmm...well now, that would depend on whether the trailer was skirted, anchored, and added on to wouldn't it? Also, I am not sure, but I believe the value of autos up on blocks and animals grazing in the yard is included in the value, then the standard of living is raised.

No, Winnebago isn't required...Airstream will do!

Yeah he did, and you know what else? Sometimes he can be very rude and condescending.

However, I have been around here for a year (not much time at all compared to some), but long enough to know that his legal advice is right on the money. Not only that, he just has the nerve to say what most of us don't. Day in and day out, there are posters at FA who are so moronic; you wonder how they even got their computer booted up that day. People who are too lazy to type something into the search bar, but want someone else to do it for them. People who get pissed off when they don't get the answer that tickles their ears. That gets annoying and tiresome for the regulars who are here to help others on their own time, with no compensation.

So yeah, you can dislike him for being short and crass at times, but if you read his posts; at least he knows what he is talking about, just many of the other "long timers" here. The regulars here have helped a WHOLE lot of people, and who can really blame them for getting tired of whining little babies who want something for nothing, then complain about what they get?

Great post TLWE!! And so so true. A few days ago a poster asked where our original posts were and why we were still here. We're here not only to learn more and but to also help others. We give out the links. We admit when we aren't sure about something and try to help where we can.

I'm sure he knows what he is talking about and I'm sure he has helped many, but it does not justify his ways of speaking to people who are only here for help. I am sure that most are here just to get good advice and not to be degraded and judged by the way they ask their questions.

Many would agree that personal opinions given to them without asking for them are not welcome.

I never would have thought that this forum would be about grammar and english lessons, but about obtaining simple legal advice.

Further to your reply, if you all are here to help people with legal situations than that is what you should be doing instead of replying with needless opinions and remarks. Obviously this does not apply to the couple of people that have tried to help me in a professional manner.

I do admit that replying the way I have been is childish but I also refuse to sit back and take criticism from people that do not know me. I asked a simple question and expected the same type of reply.

Have some respect. No one is perfect.

Would you rather hear it here or in court when the judge throws out your motion, petition or filing because of a misspelling?
