What is the name of your state (only U.S. law)? PA

NCP has arrears for unreimbursed medical. We went to court in 6/10 but I didn't start receiving payments on the arrears until 9/10. He has a wage attachment. He just called to say that his arrears should have been payed off already based on what has been garnished from his wages. He states that Domestic Relations told him that there is a provision that holds funds in reserve and that it's normally a small amount but his is up to over $1000. Just in case he looses his job. He couldn't tell me what the provision is called, but wants to know if I would be willing to waive it so that what's in the reserve pays off his balance and he no longer has a extra garnishment. Because otherwise, this 1K would just sit in an account as a back up until our son is 18.

Anyone know what this "provision" is? Is this something I can and/or should waive? He also said that his Tax Return got seized, but I have received no additional payment. What priority does Child Support have against other liens? How long would it take if it were to go to child support for it to get applied?

Meanwhile we have a hearing this month because there is an addt'l $900+ he owes in unreimbursed medical from the time period of our last hearing.

I would tell him to take it up with CSE. You certainly do not want to waive anything without understanding the entire system. Ask CSE to explain it to you - and to tell you the consequences if you give him the waiver he wants.
