My husband and his ex have a 12 year old son - they share joint custody. He and his ex attended mediation at the advice of both of their attorney's after a year and back and forth banter with little assistance to changing custody. Long story made shorter - they still have joint custody but my husband now shares equal parenting time. Both parties signed the new parenting plan and my husband filed it with the court. In addition, he filed for a change in child support, simplified procedure, due to a significant child support difference with the new plan, without his attorney, assuming this would have been a simple fix now that the childcare plan was complete. Ex's attorney filed a request to dismiss based on the fact that the new plan is "experimental" and "non-binding" and "set to expire in May at which time the parties may go back to the old plan". Everything written in the request to dismiss makes no sense and doesn't jive with the plan they both signed in January. Anyone think this might just be a stall tactic? Could we be missing something? Both parties signed the agreement and it's been filed - we're lost!
