When my husband goes to court for cs modification due to the 8 month old twins we now have together, can the difference go all the way back to when the babies were born? I know a CP can get "back support" for a child, so I was wondering if this would be possible?

Usually a court will only go back to the date of filing the motion to show cause. It depends on state laws and sometimes the judge.

As for your friend, there could be other circumstances you are unaware of . She may have already had a court order that has not been paid....she may have been married to the NCP...the state law may allow an order to go back further, etc.

A judge is not likely to allow an order to be made retroactive to the benefit of the NCP, as it may cause "hardship" to the CP and child.

Oh, and if your husband makes more money then he did when the original order was filed, he may find himself paying more. Just food for thought.
