What is the name of your state (only U.S. law)? NY / NJ

Hello,
In the Child Support section of my divorce decree it states under Education that both parties are responsible for all costs. It's almost a 50/50 split.
My ex husband is claiming he can't afford to pay his share of tuition for the school my daughter will be going to this coming Sept. 09. The school is a semi private school - he says to put her in public school and that's that.

My question(s) is this:
1. What happens if we can't agree on what school to put my daughter in ?
2. Am I going to have to go to court again to have him justify not being about to afford the tuition ?
3. Is there anything I can do to insure my daughter doesn't wind up at a bad school just because he doesn't want to pay ?

What exactly does the court order say in regards to paying tuition for a semi-private school?


As for the bolded part, nope. Send lil miss off to public school. Nothing wrong with that. A judge is NOT going to force someone who doesn't have the financial means to pay for private school.

Agreed. If he did not agree about a private or "semi private" school, it's unlikely he'll be required to pay for one.

hhmmm ... the paperwork only states that we are each responsible for all education costs. No mention of public or private school. It does say we both have to agree on which school.

I guess my hands are tied. Don't get me wrong, I'm not trying to get blood from a stone. This man makes over six figures (and a bonus!!) and has a live in girlfriend who makes the same ... LOL ... his share of $230 a month would not hurt his wallet in any way ... LOL. He's just being a SOB because it's a control thing with him. I guess he know's that if he cries poor I can't do much about it ... and unfortunately my daughter will be the one to suffer in the end.

p.s.
I'm not against public schools in any way - it's just that the schools in this area aren't that great and kinda scarey ... LOL.

Then yes your hands are tied because the sorry SOB won't agree to anything that's not free.
Maybe he just can't afford it anymore. Times are hard all over.

If mom wants it bad enough, she can pay the tuition. I am sure if someone else was footing the bill, he wont' have a problem with it.
