I'm from Massachusetts. I'm married to a man who fathered a child 12 years ago with another woman. She had support terminated shortly after it was started 12 years ago. Now she is taking him back to court all this time later to file for support again. My worry is that I have a child with this man, and he fully supports me and the child who is 3 years old. I know he is obligated now by law to pay for the previous child regardless the fact he hasn't paid for the child all this time. But I'm concerned about how courts take into consideration the fact the man now has a wife and child to support because he went on with his life. He was not a deadbeat (i.e. not deliquent on active orders) in the case of the other child. It was a case of the mother wishing no connection with the father. We have a very fixed income as it is. What happens if he becomes unable to support me and my daughter due to support of the other child? Do I have any recourse to protect my best interests along with my minor child?
Also, we still do not know what reason she used to terminate the support. Would it have ever been possible for her to of had the parental rights of my husband severed without having to have him personally in court? (there was a positive paternal test in the case, but she claimed all the time he was an abusive man and she was frightened for her life as well as the childs).
