Child support STILL being taken out of husband's check even though he has custody

We did everything they asked us to, we submitted a copy of the court order to the child support worker, she said it would be "no problem" since everything was spelled out so clearly in the order. They said they would contact hubby's employer to stop garnishment. He got his check today with the normal amount taken out. He is understandably furious about this. With school just around the corner, the kids both in sports, and no support coming from Mom, he could use every penny to go towards the kids, I'm stretching it to the limit trying to provide for them the best I can. We have no idea whether the money is just going to the state, since she was on welfare (is no longer) or going directly to her. He owes no arrearages. What do we do and can he recover the money paid out since the date the order was signed once they finally do stop garnishing support from his check?

. . . and, when you called the D.A.'s office, Child Support Enforcement Division, what did they say to you ?

Awww, man, you got me :o in my haste and anger I completely spaced it out. And I'm not even blonde!

It's Minnesota - Anoka County, again I apologize profusely, I'm feeling very "Stacks"- like right now:)

Actually hubby called up and left a message since they were not available. I think he might be taking a trip down there after work. Just was wondering if anyone had any insight in the meantime.

Oh, no. No one should ever invoke the "Stacks" name for anything !

Okay, thanks. It's always useful to have a State name, because we never know how a thread will develope. We may need it, and we may not.

But, the only "insight" I can offer at this point is that you and I, and everyone here, knows a "snafu" has occurred. It always does with public agencies. Other than that, you and hubby will just have to wait for a response from the D.A.'s office.

So, let me know the outcome. I have a feeling that they'll say, "Oh, the paperwork hasn't caught up to the file yet", or some other nonsense. Anyway, I'm sure it will be cleared up and reversed.

This happened to my husband just this past year...he had a child 10 yrs ago...about 4 yrs ago the DA called him in to discuss the welfare issued to the mother during the first 10 months of the childs life (the mother has waived any child support) but he was to repay the state for the 10 months (no big deal) any way it took 3 years to pay off (wage assignment) this past Oct. it was to be paid off...they kept taking until we filed fro our taxes and they took alot from that...well thats when we called and they realized that they made a mistake and they did repay us but it was going to take about 6 weeks....it is competly off his checks and he called the IRS and therre is no attatchments to his ss#, so it just takes a while eventually you should get it all back...just keep calling
