I pay x amount of child support to my ex-wife for our children. At tax time, I am seen as a man who makes a certain amount of money and has no one else to take care of, as I am forced to only claim 1. Therefore, the gov't sees me as making too much money, although after child support, the amount I bring home qualifies me under the poverty level. On the other hand, the amount I send in CS to their mother is tax free. I want to know if I have any legal rights in asking the courts to order that we split the 4 children...2 with her and 2 with me. She makes about the same amount of money that I make yet gets a tax free check from me each month. She verbally agreed in our divorce to split the kids each year and has not kept her word stating the law says she doesn't have to. Please advise. Thanks!
