Will I have to appear in court in the state of IN to have my child support payments terminated when my child reaches the age of 18, the child has already quit school?

Child support in IN goes to age 21 or emancipation, whichever comes first. Therefore its not an absolute guarantee that you will be able to stop child support at age 18.

Yes, you would have to appear in court or be represented by an attorney, to attempt to emancipate the child and terminate CS.

Thank you for the reply.

I understand child support is normally paid until the age of 21 in the state of IN. However he will be 18 years old Jan 2010.

I have an email from the mother stating that he has been using illegal drugs, drinking alcohol, having sex with a 15 year old, vandalising property, has been in JDC more than a dozen times, has been in a mental institution, has lived with other relatives and many other things that are outside of the guidelines that require one to pay child support. I do not want to continue paying child support for a young adult who is doing everything to destroy their life and nothing to help themself become a productive citizen.

So...you planning on doing anything to help your son become a "productive citizen" (other than trying to pull the financial rug out from under him, leaving mom to deal with all of this?)

So, I take it you have no legal or physical custody/visitation with this child?

Does the statute say "pay to 21 unless your kid is a delinquint"? The money goes to MOM for the rasing of the child, not the child.

you know, just a thought came to mind since i saw another thread yesterday with state involvement. would the JDC (state) be able to come back after dad for reimbursment? then in effect paying child support twice? was this something that should have been done once the child entered the JDC? thus making mom be equally responsible?

I dunno, I'm not from IN.

I'm only familiar with one case in MO where a child was remanded to the custody of the state due to behavioral issues. He's currently residing in a group home, covered under the state insurance plan, and receiving therapy, job training, counseling, meds, etc... and the state is NOT seeking child support from the parents.
