husband and i are seperating (mutaual)
i want to have somthing put in writting (& noterized) sighed by both of us re: child support beeing paid not thru state. and insurance premiums. and visitation.
will this hold up in a court of law (if came down to that)?
and what kind of info should be put in the document?

My response:

When it comes to the welfare of children, private agreements are worthless in a court of law. You could have one notarized 10 times, and it wouldn't make any difference. You cannot, by law, take away a court's "jurisdiction" by a private agreement. A court must render a visitation, custody and support order.

So, to directly answer your question, your private agreement would not "hold up" in a court of law.

there are DEFINITELY simpler ways to getting the technical paperwork done. if you and your soon to be ex can sit down and draw out all of the details and agree upon everything - YOU ARE DOING BETTER THAN MOST!!!!!

if you can agree upon the terms, you could use a paralegal to draw up the paper work for you and submit it to the judge. if neither of you are contesting, it is really a simple matter and shouldn't take long or alot of money.
