overtime counted on child support?

What is the name of your state? California

My question is: Are overtime hours counted on the childsupport order or can I ask for those hours not to be counted. My husband is working two jobs 8hrs and a 4hr jobs. I work a full time 40 hrs. we need the money. My husband's ex chose to work only 30 hrs a week.the more you work the more they take...What can we do next time he goes to court for childsupport adjustments, which will happen!! I have to support two of my own children.

sorry for mix up... her lawyer took the money amount and decided from that not the hours and we did not have a lawyer but felt we got cheated. Can my husband go back in court and ask for a review?? He already got stuck with all their bills and we are now planning to file for bankrupcy and she is still asking for more money when ever she can. Thank you for your quick response.:)

He does not have to give any more money than the court ordered amount and if he has been then he is stupid. Sorry he got stuck with the bills but that was in the divorce agreement and if there are some she is responsible for paying but she isn't send a copy of the court order to the creditior. CS can usually only be changed once every three years unless something life changing has happened like loss of work, or children are born to him. Do you work? Sorry got mixed up on who was who. My apolgies. You will have to try to go to court and must get a lawyer because you can not file bankruptcy on back child support, you can however maybe take turns claiming the children on taxes, that might help a little.

tried that, she will not agree on anything and will not do any favors. we are filing for bankrupt and not planning to count the childsupport anyways. the children deserve that money, but we are mainly getting rid of his old bills so we can start new with OUR bills.:rolleyes: we were trying to avoid using a lawyer, short on money...but i don't think it was fair for his overtime hours to be counted for childsupport. he wouldn't of worked overtime if it was going to raise cs. We are trying to make ends meet. when its not one thing is another, some luck...thanks for the advice;)
