Child Support

I realize that all laws are different however I have a couple of questions in regards to child support. First, if child support isn't received and it has to go back to the courts can the custodial parent put the legal costs upon the non custodial parent?

Also what is the length of time before you can "find a biological parent and request back child support? Is there an age when you can no longer request such.

Just reading these wonderful forums and find them quite interesting. I aid in running a non profit Supervised Access Program in Canada and even though it is American laws and advice it is informative to read. Thank you.

In my case it was written in the court order... that if a party took the other party to court and lost they had to pay the other sides fees. But the courts did not award my attorney with my X-wife having to pay those fees.

Also what is the length of time before you can "find a biological parent and request back child support? Is there an age when you can no longer request such.
This is a little touchy, dont you think? Did the biological parent know he had a kid? Why would you wait? Has he paid you any support before?

The cp can request the ncp pay legal fees but it's up to the judge normally.


Also what is the length of time before you can "find a biological parent and request back child support? Is there an age when you can no longer request such.
That's state specific.

All of those questions are state-specific, and the answers may or may not apply to Canadian law.

Thank you all for your advice. The biological parent was very aware that the child existed and saw her until she was 4. She is now 23 and was just wondering. Thanks again.

I don't think there's one state in the US that will allow paternity establishment at age 23, but you can go here and check each individual state:

21 is usually the max, with many states denying paternity establishement after age 18.
