What is the name of your state? Alabama

My fiance has two children from a previous relationship. He has them every other weekend and 8 weeks during the summer. He pays child support each week. The mother has now stated that she is going to take him back to court because the children stay at a daycare until she gets off from work each day. She has stated that he needs to pick them up every Monday, Tuesday, and Thursday from day care every week or she will take him back to court.

When they separated the support was based on both children being at a daycare everyday while she worked. Now both of these children are in school and spend less time at the daycare so the actual everyday cost to her has really decreased. Everyday that he is in town, he actually gets them from the daycare and has them until she gets home. Her request is unreasonable because his job requires him to work evenings and go out of town. Does she really have a challange against him?

Since the datcare cost is already included in the CS order, I doubt that she can get an increase in daycare costs.

It sounds like this is more of a visitation/custody issue than it is a CS issue. Depending on if his income has gone up or not, she may find that him having the kids more often may result in a decrease rather than an increase.
