I live in NYC and I was recently ordered to pay child support for my two children in which one of them is not biologically mine but I have been helping to raise this child even though I do not live in the household with them. I have always provided clothes,furniture, food, etc. for these children since they were born. Now that we have went to court I am being treated as if I have done nothing and I am a deadbeat.I also am being forced to pay back support. I would like to file an objection to the examiner's ruling on the following grounds:

One of the children is not biologically mine

Inproper Service of Papers-( I was served the papers by the mother)

The examiner was very rude and verbally abusive.

Do I have a leg to stand on?

Ok, a couple of ??'s for you.
Were you with the mother t the time of the birth? (the one tht isnt yours)
Were you married to her when she gave birth to that child?
Was your name put on the birth certificate?
If any of these are yes, then also how old is the child?

To answer your questions: No I was not with the mother at the time of birth. She was involed with another man at the time. We were never married and yes my name was put on the birth certificate and the child is 11 years old.

Are you saying that even though you knew the child was not yours, you still allowed your name to be placed on the b/c ? Did you sign anything else like an affidavit of paternity etc ?

Let me start from the begining When this child was born I was told it was mine even though me and the mother were not together at the time of birth but we were together around the time the child was concieved. I did not sign anything at the hospital. I was told that the child was not mine about a year after he was born and who the father was. Since I had been Helping raise this child for a year already and I knew that the real father was not going to be in this child's life I decided to continue to help raise the child. About a year ago she asked if I mind putting my name on the birth certificate along with my other son since I was the only father he has known. My name was not on my sons birth certificate because the mother was on public assistance and she told them she did not know who the father was in order to keep her benefits.
