I live in New Hampshire and my exhusband lives in Mass. We are going through the mass courts.My children have one and two more years of high school. My exhusband owes me over $60.000.00 in child support and is not paying me. I have a court date in December. I am going through the department of revenue as I can not afford an attorney. What are my chances of recieving any of the back support? Seeing My children are 17,16,15 years old can you tell me what to expect from the courts.This has been going on most of my childrens lives going back and fourth to court for support.
I am remarried and recently had a child with my husband. I want to quit my job and stay home with my baby. I can only do this if I am guarenteed to get support for my other children. I carry health insurance for my girls as my exhusband is not responsible enough to keep a job to carry their insurance. My husbands company will not cover my girls as they are not his children or he would have to adopt them.If I quit my job I will loose my health insurance. From what I understand addoption would be a costly process and I can not take on this extra expense.Is there any hope?

It will most likely take time to get the arrears, but they will get paid. The key to this is that even after the children turn 18 he will still owe the child support that has accumulated up to their 18th birthdays or when they graduate HS ... The Dept of Revenue(?) will also be able to flag his IRS refunds so if he files and has a refund due you will get that. I would push for the probation if he hasnt had it yet and that will enable you to seek jail term for him if he misses a payment while on probation.

Under Federal CSE laws, the IRS can get involved in cases of child support arrearages after they reach a certain dollar amount. They have the ability to seize property to fulfill these obligations just like they do for debts owed for Federal taxes.

I do not have any legal advice to offer as far as the courts go. What I can tell you as a person who recieves child support through Massachusetts DOR/CSE is this:

If your ex is more than $500 behind in CS payments, Mass. DOR/CSE automatically sends this info to the IRS, therefore flagging his return. They will take (in your case) ALL of his Federal return refund money, and then they will take his state refund too.

This, of course, hinges upon two things. One being if he bothers to file. and two being if he gets a refund.

What I can tell you also is that if he does file, you will get that money through DOR/CSE. Last year I got my ex's entire federal AND state refund monies. Guess he didn't know about the tax intercept program!
