my wifes sister lived with us after having her baby.this was for three months 1st time and 9 mths the 2nd time. she never has sought child support from the babys dad. they were never married and she didn't even live with him. he has a shady way of employment and she dosen't want to get him involved in the courts about his income. my question is am i entitled to sue him for support for the time they lived with us? we live in texas and the babys dad lives in ok.

The mother of the child is the only one who can go after the father for child support. The father is not legally obligated to you in any way.

Does the father KNOW he's a father?

Doubt it very much.

No one can pursue him for any support until he is ordered to pay support....can only do in court.

If you could and did sue..given issue..I would think may bring court's attention to matter of child support..thus so you not sueing him again for supporting mom next 2 yrs. Seems you would have to show/prove he owes child support to reason why you would have right/issue to sue him..does that make sense?
Don't know, might be worth law consult and you may want to check your state laws on children born out of wedlock,paternity & support. States vary but many states have statute of limits on pursuing support in this type situation. Mom needs to know if may ever want support. My state, if paternity not proven by 3 yrs after birth, done...if pat proven within 3yrs, can pursue support until child 18. Worth a check into probably...
