What is the name of your state? Mississippi
Last night my 16yr old son left the house mad at his mother and I and an 18yr old boy took him across the state line to t town 4 hrs away. Can this be considered kidnapping even though our son went willingly?

we both have custody as we are still married the 18yr old male is of no relation to us

Ok. you're still married and living together or separate without any court orders or anything? If that's the case then no... who do you expect to file kidnapping charges?

ok so this teenage boy can take him across the state line without mine and my wife's consent after us tell him not to leave and we can't press charges on this 18yr old?

we are married and still live together and he the 16yr old is our biological son the 18 yr old is not related in any way he just lives in the neighborhood

The 18 year old has nothing to do with this. You stated YOU took him outside the state, YOU are the parent, YOU were there when it was done, giving your consent. The 18 year old has nothing to do with this other then he hitched a ride!

tiggs - I think you're misreading the situation. The 16yo was mad at Mom & Dad. The 18 yo took the kid out of state against the wishes of Mom & Dad.

PKendrik - commas in the right places help in clarifying the situation - your sentence could have been read (as tiggs did) that you and the 18yo took your son out of state. Yes, you can report this to the cops and the 18yo is in a sh*tload of trouble.

Tig, I think the kid was mad at his parents and took off with the 18 year old, it can be read both ways.

I thought one of the prerequisites for kidnapping is to take someone against their will?

If the kid went willingly, how is it kidnapping?

Who did mom and dad tell "not to leave"? Their son, or the 18 year old?

OH OK.. duh.. yes Stealth you are correct. I read it that the boy was mad at mom and that dad and the 18 year old took him out of state....

Stealth is correct. It might not be kidnapping ... but runaway and abetting a runaway.

You need to file runaway charges against your son.. giving the police the story IN YOUR town as that is the home of residency
