my grandson lives with his mother. my son, the little boys father, does not live with them. my grandsons mother has now decided that she does not want my son to see his son. they were never legally married. the little boy has his mothers surname. my sons name is not even on the birth certificate. although she has never said that he is not the father. this is taking place in the state of texas and i am wondering if she can legally do this? also, i am worried about the fact that she may tell me, the grandmother, that i cannot see him anymore. do i have any legal recourse if this happens? and what does my son need to do to get legal visitation?

Your son needs to go through the courts to establish paternity of the child, then set up child support and visitation arrangements.

Until he has court-ordered visitation, the mother can deny you permission to see the child. Grandparents have no right to visitation, but once your son has access to the child, you can see him during his visitation. Good luck to you!
