What is the name of your state (only U.S. law)? Arizona,My brother who lives in Wisconsin and his fiance who both have a 2 year old son are having problems,and she has mentioned to my neice she wants a one way ticket back to Va.She plans to do this without my brothers' permission or knowledge.Would this be considered kidnapping even if they're not married?

Is he legally established as Dad?

(no, it's not kidnapping - though Dad has the right to file in court to have the child returned to the home state...assuming that Dad establishes paternity)

Dad should immediately file to establish custody, CS, and, if his child, set up a shared parenting plan, with joint physical custody and jt legal. In their current county of residence. And ask for a geographic restriction.
