I live in Pennsylvania and I have a question about parental responsiblity for a child's legal fees. My son was arrested for pulling a knife on his Dad' s girlfriend in an argument. He had to obtain a lawyer because during the preliminary hearing, the court officer determined that his father salary and my salary combined was too high for a public defender. Since then, my son was pulled from the Dad's custody by Children's Services. The father makes double my income and I think he was the main reason we had to get a lawyer. The father is in total support of his girlfriend and even testified against my son in court. My son was taken from his custody for physical abuse. He has not tried to get him a lawyer or help me pay for the lawyer. I had to pay $1,800.00 for an attorney to defend my son. The officer did not say the mother has to get a lawyer, he said the parents have to get a lawyer. Can I take his father to small claims court for half of the legal cost.:mad:
