What is the name of your state?Indiana :mad: I have contacted a Social Worker that the CP was taking our 3 yr old to. I asked her for copies of his file and she told me that I have to set and pay for an appointment first. Is this feasable and do I have to pay a visit fee of 80 dollors just to get the copies of the record? Please help.

indiana How is that direct access? indiana Code 16-39-1-7 and code 16-39-2-9 I also made appointment in July of 04 and Social worker still refused to give copies.

Mental Health Records:

IC 16-39-2-9
Sec. 9. (a) For the purposes of this chapter, the following persons are entitled to exercise the patient's rights on the patient's behalf:


(1) If the patient is a minor, the parent, guardian, or other court appointed representative of the patient.
(2) If the provider determines that the patient is incapable of giving or withholding consent, the patient's guardian, a court appointed representative of the patient, a person possessing a health care power of attorney for the patient, or the patient's health care representative.

(b) A custodial parent and a noncustodial parent of a child have equal access to the child's mental health records unless:

(1) a court has issued an order that limits the noncustodial parent's access to the child's mental health records; and
(2) the provider has received a copy of the court order or has actual knowledge of the court order.

If the provider incurs an additional expense by allowing a parent equal access to a child's mental health records, the provider may require the parent requesting the equal access to pay a fee under IC 16-39-9 to cover the cost of the additional expense.


I would suggest, however, that you actually attend an appointment. You will learn more about why your child was seeing a counselor- You will demonstrate your interest in their mental health- You will get an opportunity to be involved in their counseling. If it costs $80, it would appear your child does not have insurance. If your child has insurance, it should only be the cost of the co-payment and costs of copying the records.

I did set app. in July and SW refused to give copies. My 3 year old is not developed enogh to even know why he is going or what is going on. My insurance did pay for his and my visit, but they also paid for 36 other visits for him that I believe were not needed or was anything ever helped on his behalf besides play time.
