childsupport after relinquishing rights

What is the name of your state? CAlifornia
My ex finally agreed to give up his rights so that my husband can adopt my sons. He owes child support for the last 2 months.Does he have to pay that before closing the support case or is it dismissed? I asked him to give up his rights before I filed the support order but he denied. He was in and out of their lives and my oldest took my husband as his father and called him dad. My ex asked me to close the support case so he can file papers and give up his rights. He said the lawyer he talked to told him I had to close it. Is he just trying to avoid paying for back child support? What forms should I file If I wanted to do it myself instead of him? Since we agree on it can we split the costs? thanks for any responses.

How old are your children? Two months worth of back child support--is it worth it?? I don't know if they will close the support case until/if they are adopted by your husband. Are you 100% sure that this is the right thing to do FOR THE KIDS? What happens if you get divorced in the future?

Sorry--but I feel that dads should be included as much as possible in raising their own kids.

Yes, it is in the best of the children they are 8 and 9. The father was never really around. He would see them maybe 4-5 times a year!! Now he is planning to make a new life and moving to Florida, we live in California. He has no plans to be around his kids or make any efford in to it. I can't do this by myself I need him to put some effort too. My husband has been there for most of their lives 24/7. We are so lucky to have him in our lives. My ex now has 3 other children to which he gives a little more attention but not enough as he could. It seems that his kids are secondary in his life.He is not with their mother either. I wish them luck and hopefully he will realize he is missing so much.

Well, since the child support was owed prior to the adoption, odds are he is going to have to pay it.

...and I think it's great that your husband wants to adopt your kids, and I think it is equally great that you have the faith in him to allow him to do so.

It sounds like you love him very much, and it seems rather apparent that he loves your kids very much as well, since he is willing to adopt them.

Kudos to new adoptive Dad!
