I was cited for parking violation code 50. I walked out of a bank as the traffic maid was asking about the parked car and I told him I will move the car but I did not see any marking and I had just drop off my elderly relative to that bank. It appeared as though it was a handicap cut off (at least to me) since I don't live in the same borough as my relative. The idiot wrote the summon anyway.

I looked up the code which states: "Stopping, standing or parking in a crosswalk."

I honestly did not see any indication of a cross walk at all. I will go back ther e and take photographs. Will that fly w/ the judge. I plead not guilty?

Also there is this disclaimer " Note: Crosswalks are not always identified by painted street markings." Can I use that as a defense?

If by "handicapped cut off" you mean the handicapped curb cut, that qualifies in most places in the city (other than certain T intersections) as a crosswalk.
You're not allowed to park or even stop or stand there. The offer to move your car is meaningless, you'd already committed the violation.

No, as a matter of fact, that phrase is telling you that you won't be able to use that as a defense.

"Thou shall not assume". That should be the 11th Commandment. How would hou know what I said. You were not present. Keep your nasty comments to yourself. Are you a defense lawyer for city empleyees?

I was frustrated that I was hit w/ a $115 so "the idiot" can fullfil his quota and earn his meager pay check from the city. It has nothing to do w/ enforcing the law.
