civil breach of contract

I have just been served with a civil suit resulting form a breach of contract. About 3 or 4 years ago I entered into an agreement with a company the school used to rent music equipment to children. I signed up for a snare drum for my duaghter. The company came to my home (it was some local guy running this business out of his home). I gave him my CCard and signed an agreement. They sent payment envelopes which I gave to her father since he said he would pay. After a year she quit and we wanted to return the drum. We called the number but all you get was a machine, nothing stating who it was just a you've reached ####, leave a message. We never got a response and had no address with which to return the drum so her father just stopped paying. THat was over 2 years ago. THey are just serving me now. I have called the same # to try to resolve but have gotten no reply. We still have the drum in good condition, and have wanted to return it but had no way to do it. The suit is for $427.00
I dodn't mind paying for any time we have had the drum before we tried to return it, but $427.00 is a bit much for one snare drum.
How long can someone have to file for something like this. It seems since I have supplied them with a phone, address, and ccard, they have had ample time to contact me regarding this matter. Any insight would be greatly appreciated.
