Just an interesting question. My family and I reside on a property where my business is also located. My daughter and I (she's 15) testified against the property owner's brother in a child molestation trial, and now she and her ex-husband (who still lives with her) are making our lives a living Hell.
Long story short, we're moving, my business is moving, however our move won't be complete for another couple of weeks. In late October I filed for a Restraining Order, the Ex Parte was held and I was granted a TRO. These folks have constantly violated the TRO and kept harassing me, my husband and our daughter. A Sheriff's Deputy has told us, don't bother to call for a Deputy (I haven't yet, not wanting to cause even MORE harassment for myself!) because it will go to the DA and the DA will just toss it aside, saying it was a "civil matter". Well, DUH! Of COURSE it is! Isn't that why it's a CIVIL harassment Restraining Order?
Anyways, what I was ultimately wondering, is there any standard for being awarded damages for Emotional Distress in a civil harassment case? Surely I deserve SOMETHING for all this nonsense these folks have put me through...
