I need Help-PLEASE!! I am on the recieving end of a civil lawsuit. I do honestly believe I am somewhat at fault for. My dilemma is I simply do not have the money the plantiff is asking for. How can I settle if I don't have the money to give? If I go to trial the sum could be larger and I REALLY won't have the money to give. I can't take out a loan, can't borrow from friends or family. What are a persons options when they don't have the money?

You may be able to enter into a settlement with a payment schedule, with payments that you can afford to make.

Bankruptcy can also be an option, but you have to see a good b/k lawyer to discuss whether or not this a good option.

The platiff said he is not willing to take any type of payment plan. He is requesting one lump sum. I just don't have the resoures to do that. I can't take out a loan, borrow from friends etc. If I file bancruptcy am I liable for punitive damages?

My response:

How much money are we talking about here? And what is a good estimate of your total debt load? Why do you believe "punitive damages" are a factor in this matter? Did you do something to this man with purposeful and malicious intent?
