i live in wisc. and am curious how this would work. my wife can claim 2 of her three kids a year. their father is allowed to claim 1. if he is not working and hasn't for about 2 yrs, does he still have the right to claim the child?

Sure he does. Him not working has no affect on the order. Besides, if he's collecting unemployment, he'll have to claim that money.

It's probably going to be a wash in the long run, but the order stands.

ok wasn't sure. although just for the record he's not getting unemployment. he's getting food stamps. he quit his job working for his dads business and see's no need to get another job since the stats paying for everything.

In that case, offer him $100 to sign a form 8332 that will allow you to claim the child. In fact, you can even have him sign a form to allow you to claim the 3rd child retroactively for 2003, 2002, 2001, or 2000.

The custody order the beginning negotiating point, not the writ of god.
