What is the name of your state?Minnesota
I am wondering what is the ramifications for pursuing a remedy in class action lawsuit that has closed? Can a person still retain independent counsel to sue if they have missed the class action period? The literature that we are receiving form the insurance company states that we cannot pursue further legal action because the class action is closed. Is this true? It woudl seem that the company lost once and it woudl be easy to win against them.

That's the purpose of a class action -- to resolve all similar claims at once so each plaintiff does not have to sue independently. However, as some people have major claims, think their situation is a bit different from the class as a whole, and/or want to use their own counsel, so members of the class are given the right to opt out. But if they do not, they are bound, win lose or draw.

If there was a proper class, the court had jurisdiction, and you were given appropriate notices (such as if the notice to you was sent as the court ordered, and you sat on your hands, now it would be too late. You are entitled to your share of what the class won, no more or less.
