Closing CSE case - when to pursue?

What is the name of your state (only U.S. law)? I live in SC, child in Ga, divorced in OK, and CSE case w/VA. I'm military

My decree states that I'll pay CS until my daughter is either out of HS or 19. She graduates around May of 2012 and will be 18 1/2 by then.

I know it's early to ask, but I'm curious as to how I would go about closing the case. Judging by how slow DCSE can be about some things, I figured asking now couldn't hurt.

Do I start by contacting DCSE?

You would best file a modification for child support ordering an end date. If you are being garnished, you'll want to word it so that your payroll can confidently stop pulling funds from your paycheck.

Are you completely caught up? No arrears?

I would wait until closer to the date of graduation, but if it is only an administrative order, contact your caseworker to advise the child will be graduating to terminate the case.

Furthermore, if you have CO's involving support, you may want to file to modify the order (again, closer to the grad date) with the court system.

My CSE case is in Va, which in turn works with one in Ga for the same child.

If I understand correctly, you're saying to to the court where the case currently is (Hampton, VA) and file to modify from there? I just go to the courthouse and ask for the right office?

Then, I'd let CSE know that I've done this. Am I right?

Finally, pursue this say...a year out or so?

Definitely wait until you are closer to the date. You will have to serve CSE as part of the process.

Yes.

You can call the clerk's office and ask them (nicely) to give you a time frame that they are currently setting hearings for support. If you're lucky (and nice) the gal can tell you, "We're scheduling now for November" and you can get a better idea of when to file. I would call about 6 months before she graduates and try to get your court date about 2 months from graduation so that you will have ample time to get your new CO to VA CSE so that they can get it to GA.

Actually near the end of school year, you should receive a letter from Virginia DCSEA asking when graduation date is, asking yet again birthdate of child, they will then schedule a hearing right after graduation to stop CS.

But if you don't, call them to ask for it. Any support you pay is probably gone for good - even if it SHOULD HAVE been stopped earlier.
