Today we had our "final walk through" for a house we had built in a neighborhood. Our closing is on June 29th. During the walk through, the builder rep stated that they had a survey completed last week that showed the neighbors fence to be two feet on our property. He told us that we would have to deal with it and have the neighbor move the fence. This is a builder and the neighborhood is all built by the same builder. We told them that it was their problem and they need to take care of it before closing. He said that the surveyer came in and marked the property and that "someone" moved the marker after the survey. He said that the surveyer moved it back and left, when they returned it was moved again. Should we put off the closing until this is taken care of, our realtor said that you can not close on a property with someone elses fence on it.
