My son recieved a DUI , about 1 month ago in south Carolina . His license was suspended for 30 days. Traffic court was today 12/2/2010. He has asked for a jury trial . My question is ( if he hasn't been convicted yet then why can't he get his license back ?) If he has to take ADSAP , then why want they enroll him ?

He's suspended for 30 day administratively for blowing .08+ completely separate from the criminal charge. Once he's convicted of that, he'll lose it for six months. He's no going to get ADSAP until the court case is resolved. He'll need ADSAP and SR-22 before he gets to drive again. He's looking at up to 30 days in jail and while there is technically a 48 hour mandatory minimum in jail, the judge has the discretion to substitute community service for that.
