My wife and I own a studio apartment in NYC. The building is calassified as a"Condop". The sponsor of the co-op owns the commercial portion of the building as a condominium. He also owns the manageing agent and is vice president of the co-op and condo board. When a new commercial tenant moved in about three years ago they installed equipment which vibrates our apartment continuously.
We spent years asking for help from the co-op,the manageing agent and the sponsor of the co-op (who is the landlord for the commercial space) and were not only ignored but missled into thinking that they actually intnded to act on our behalf.
We were unable to sleep in our apartment and my wife eventually had a nevous breakdown.
When it became clear that we were not going to get help from any of the parties involved with our building we began to seek help from NY city agencies uncluding community bd meetings etc.
After almost 2 years of that we finally hired a lawyer to defend us in court.
After discovering that one of the lawyers on the firm that we hired used to work for the sponsor of the building we're afraid that even our lawyers are not acting in our best interest!!!
Its been a year and a half in the court system with no trial in sight.
What is happening to us?
Can we sell our apartment without making this worse? We are running out of money and we may be forced to sell just to contunue our fight!
