I live in California. My dog was taken in the state of Colorado. I co-owned her (Jenna).I had Jenna since she was 6mo old and she was now 5+ years old. I left her with my ailing mother in Colorado for company temporarily;knowing I would return every 4-6 weeks to help Mom. As soon as I left, my siblings took mother and Jenna unwillingly from her home to be with one of them to charge Mom (unknowingly) large monthly fees for (unneccassary) care. My mothers neighbor called me immediately. The neighbor offered to hold Jenna till I came to get her. My sibling yelled saying NO, she is my dog too!!! I later found out much later that she gave Jenna and all her personal items away!!! I later received the AKC transfer form from my sibling to remove my name as co-owner and pay for a transfer fee to do so. I flatly refused and contacted AKC that no change to the registration papers will ever be done by me.

I found out Jenna died shortly after from renal failure.

Can I do anything legally for her actions of what I call theft?? I am alone and Jenna was my companion; I left her with Mom out of love and not abandoment etc. Jenna was like a child and friend to me. I still miss her. Is their any restitusion that I can obtain. This would help with letting them know this action is and was not acceptable.

Can I ask why you would leave your dog with you ailing mother...? If you mom wasn't in good health wouldn't taking care of a dog be too much? :confused:

Based solely on the information in your post... unlikely. Though you claim co-ownership.... the giving party (presumably, from your CONFUSING post) had custody. A court would likely take that into consideration.

However, you are certainly free to file a small claims suit in Colorado to see if you can convince a court otherwise.... and the value of an equal property.

Sorry that my message was difficult to understand.

I was in Colorado with my dog at my mothers home. Her ailment was slight dementia and her husband had just passed away. She wanted to stay in her home. I hired a day care person and set the house up with all the needs for safety and convenience.She liked my dog Jenna for company. I left Jenna temporarily with her knowing I would return in 4-5 weeks. I was in constant contact with her on a daily basis.

Jenna was co-owned with my sister. When I left my sister took Mom and Jenna against their will and without approval. My sister refused to give me Jenna.

JEnna was given away, again with out my consent. Jenna died while in the third parties home.

What legal action can I take. Hope this better explains my question.

As far as small claims court......with better understanding of my question..do I have a better chance at getting compensated for my loss?
