It likely depends on how its titled.

It simply states that we both own the land. It's not subdivided. Just 11 acres we both own.

Unless there is some agreement or contract involved, he can build on the property. Now, something he may not be thrilled with is whatever he builds becomes a fixture and as such, becomes part of the real estate and as such, half yours.
