What is the name of your state (only U.S. law)? Michigan

We now have less than 20 employees (and have for more than 50% of 2008); is it allowable to offer COBRA in the future to laid-off employees? I understand that we are not required to offer it.

You are not required to. The law does not prohibit you from doing so if you choose.

Many if not most states require some kind of insurance continuation for employers of less than 20 employees. I'm not where I can look up your state right now but will do so when I get back to my cheat sheets.

Michigan appears to be one of the very few states that does not have a state continuation plan. So there is no requirement that you offer COBRA at either the Federal or state level.

However, as indicated, while you are not required to offer it, there is nothing prohibiting you from doing so if you choose to.
