Loss of coverage due to a divorce was 12/31/07. I am a diabetic and the health carrier was informed I no longer was to be covered on 1/1/07. Ex-husband's employer neglected to have their COBRA Plan administrator send me a continuation coverage COBEA packet. I have been in the hopsital twice due to my diabetes and had no medication coverage.

I called the Dept. of Labor and Health and they said no later than 44 days of the loss of coverage a packet had to be sent to me. Now it is June 12, 2007 that the TPA sent me a packet due to my repeated requests to do so. They are giving me until Aug 10, 2007. The employer wrote me and said sorry for the ....trouble and inconvenience... However, the Plan administrator managers are in a huddle this week because I gave them a letter asking for x amount of money for x amount of days prior to them correcting the issue six months later. This lack of them sending out the packet to continue my medical coverage resulted in consequences to me with many medical bills.

Any advice? Should the TPA be worried or am I out of luck and have to take them to court?

A simpler solution would be to file a complaint with the DOL for the violation.

The woman in the San Francisco office told me to get the money from the violation a suit would need to be filed.
