collect insurance amount?

i filed a claim with my insurance company regarding the death of my wife caused by a vehicular accident. all the papers i submitted to the adjusters of the insurance company were verified to be true. however, i am being asked about the court case my family filed against the driver of the vehicle which caused my wife's death. can i still collect the insurance amount if the case is settled out-of-court? thank you very much.

Your insurance company is interested because they will want to be reimbursed for the money they pay to you. If you settle out of court before your insurance pays, they will not pay.

in other words you wont be able to collect money from both the insurance company and the driver.

thanks, racer72 and dankk. i've got one problem... the offending driver is a distant relative and my folks want me to settle the matter. is there no other way for me to collect even a fraction of the insurance amount?

I know if you have exhausted all of you workmans compensation funds through "PIP" the regular workmans comp carrier takes over payments. they then have a lein against any funds you may recieve through the settlement of your lawsuit. the question is do they get the full amount or do they get 2/3 of there amount?:confused:
